Under the current Law of patents of Korea, is necessary to present a request of examination inside the five 5 years from the date of application (in the case an application PCT, split of the date of international presentation). To avoid problems related with the delay in the granting of Patents motivated by the long period of time of the presentation of an application of examination, the Korean law has been reviewed, shortening this period to three 3 years from the date of presentation. This new disposal applies to the applications of patent presented in or after 01 March 2017 and the applications of patent presented before 01 March 2017 that were subject to the current regulation of five 5 years in the presentation of an application of examination.
